nos devidos termos. Se o capitão do navio começar a descarregar sem permissão será multado em 500 taeis, e os objectos que tiverem sido descarregados serão confiscados. Artigo XXIX
Todo o negociante portuguez que tiver carga para embarcar ou desembarcar, deverá obter para isso uma permissão especial do superintendente da alfandega, sem o que toda a fazenda embarcada ou desembarcada ficará sujeita a ser confiscada. Artigo XXX
Não se poderá baldear fazenda de um navio para outro sem licença especial, sob pena de confiscação de todas as fazendas baldeadas. Artigo XXXI
Quando o navio tiver satisfeito a todos os direitos que dever, o superintendente da alfandega passar-lhe-ha um attestado e o consul restituir-lhe-ha os papeis, para que possa seguir viagem. Artigo XXXII
Quando houver duvidas sobre mercadorias que, segundo a tarifa, pagam direitos ad valorem, e o negociante portuguez não podér concordar com o empregado da alfandega no valor d՚essas mercadorias, cada uma das partes chamará dois ou tres negociantes para as verem, e o preço mais alto que qualquer d՚elles offerecer para as comprar será o justo valor d՚ellas. Artigo XXXIII
Os direitos serão pagos pelo peso de cada mercadoria, depois de deduzida a tara. Se entre o negociante portuguez e o empregado da alfandega houver duvidas no fixar da tara, cada uma das partes escolherá um certo numero de caixas ou de fardos d՚entre cada cem da mercadoria em questão, tomar-se-ha o peso bruto d՚esse volume, fixando depois a tara de cada um d՚elles, e a tara media que resultar será a adoptada para todos. No caso de qualquer outra duvida ou contestação, aqui não designada, o negociante portuguez poderá appellar para o seu consul, o qual communicará a questão ao superintendente da alfandega, e este fará por concluil-a amigavelmente. A appellação, porém, só poderá ser attendida quando seja feita dentro do praso de vinte e quatro horas; e, n՚este caso, até que a duvida seja resolvida, não se poderá fazer nos livros da alfandega assento algum relativo ás mercadorias em questão. Artigo XXXIV
As fazendas avariadas terão uma reducção de direitos proporcional á sua deterioração. No caso de haver duvida, será resolvida como na clausula d՚este tratado relativa ás mercadorias que pagam direitos ad valorem. Artigo XXXV
Todo o negociante portuguez que, depois de importar mercadorias estrangeiras em algum dos portos abertos da China e de satisfazer os competentes direitos, as quizer reexportar para qualquer outro dos mesmos portos, deverá fazer d՚ellas uma relação, que entregar áa osuperintendente da alfandega, o qual, para evitar fraudes, mandará examinar pelos seus empregados se os direitos foram pagos, se as fazendas deram entrada nos livros da alfandega, se conservam as marcas originaes e se os assentos dos livros estão em harmonia com o referido na relação. Achando tudo conforme, declaral-o-ha no certificado do despacho, mencionando tambem o total dos direitos pagos, e de tudo |
the Consul the report drawn in due form. If the Captain of the ship should take upon himself to commence discharing without permission he shall be fined five hundred taels and the goods so discharged shall be confiscated. Article XXIX
Portuguese merchants having goods to ship or to land, will have to obtain a special permission from the Superintendent of Customs to that effect without which all goods shipped or landed shall be liable to confiscation. Article XXX
No transhipment of goods is allowed from ship to ship without special permission, under penalty of confiscation of all goods so transhipped. Article XXXI
When a ship shall have paid all her duties the Superintendent of Customs will grant her a certificate and the Consul will return the papers, in order that she may proceed on her voyage. Article XXXII
When any doubt may arise as to the value of goods which by the tariff are liable an ad valorem duty, and the Portuguese merchant desagrees with the Custom-house Officers as regards the value of said goods, both parties will call two or three merchants to examine them, and the highest offer made by any of the said merchants to buy the goods will be considered as their just value. Article XXXIII
Duties will be paid on the net weight of every kind of merchandise. Should there be any difference of opinion between the Portuguese merchant and the Custom-house Officer as to the mode by which the tare is to be fixed, each party will choose a certain number of boxes or bales from among every hundred packages of the goods in question, taking the gross weight of said packages, then the tare of each of the packages separately, and the average tare resulting therefrom will be adopted for the whole parcel. In case of any doubt or dispute not mentioned herein, the Portuguese merchant may appeal to the Consul who will refer the case to the Superintendent of Bustons; this Officer will act in such a manner as to settle the question amicably. The appeal however will only be entertained if made within the term of twenty four hours, and in such a case, no entry is to be made in the Custom house books in relation to the said goods until the question shall havo been settled. Article XXXIV
Damaged goods will pay areduced duty proportionate to their deterioration; any doubt on this point will be solved in the way indicated in the clause of this Treaty with respect to duties payable on merchandise ad valorem. Article XXXV
Any Portuguese merchant, who having imported foreign goods into one of the open ports of China and paid the proper duties thereon, may wish to re-export them to another of the said ports, will have to send to the Superintendent of Customs an account of them, who, to avoid fraud, will direct his Officers to examine whether or not the duties have been paid, whether the same have been entered on the books of the Customs, whether they retain their original marks, and whether the entries agree with the account sent in.
