Se algum navio mercante portuguez for encontrado a fazer contrabando, as mercadorias introduzidas por esta fórma illegal, seja qual for o seu valor ou natureza, ficarão sujeitas a serem confiscadas pelas auctoridades chinezas, que poderão mandar sair do porto o navio depois d՚elle saldar todas as suas contas e prohibil-o de continuar a negociar. Artigo XLV
Quanto á entrega de criminosos portuguezes e chinas, com excepção dos criminosos chinas que se refugiarem em Macau, e para a extradição dos quaes o governador de Macau continuará a seguir a pratica até agora adoptada depois de receber a competente requisição do Vice-Rei dos dois Quangs, fica convencionado que nos portos chinezes abertos ao commercio estrangeiro os criminosos chinezes que se refugiarem nas habitações ou a bordo dos navios de subditos portuguezes, serão presos e entregues ás auctoridades chinezas logo que ellas os requisitem ao consul portuguez; e assim tambem os criminosos portuguezes que se refugiarem na China, serão presos e entregues ás auctoridades portuguezas logo que ellas os requisitem das auctoridades chinezas, não devendo os criminosos ser acolhidos por nenhuma das partes, nem haver delonga na sua entrega. Artigo XLVI
Qualquer das duas altas partes contratantes poderá no fim de dez annos pedir uma revisão da tarifa ou dos artigos commerciaes d՚este tratado, entendendo-se que não sendo feito este pedido dentro de seis mezes contados sobre os primeiros dez annos continuará em vigor a mesma tarifa por mais dez annos contados sobre os precedentes dez, e assim de dez em dez annos. Artigo XLVII
Todas as questões que se suscitarem entre subditos portuguezes na China, com respeito a direitos de propriedade ou de pessoa, serão submettidas á jurisdicção das auctoridades portuguezas. Artigo XLVIII
Quando subditos chinezes se tornarem culpados de qualquer acto criminoso para com subditos portuguezes, as auctoridades portuguezas participal-o-hão ás auctoridades chinezas para que os accusados sejam julgados segundo as leis da China. Quando subditos portuguezes se tornarem culpados de qualquer acto criminoso para com subditos chinezes, as auctoridades chinezas participal-o-hão ao consul portuguez, para que os accusados sejam julgados segundo as leis de Portugal. Artigo XLIX
Se qualquer subdito chinez tendo contrahido uma divida para com um subdito portuguez se negar a pagar-lh՚a ou fraudulentamente se occultar d՚elle, as auctoridades chinezas empregarão todos os esforços para o prender e obrigal-o-hão a pagar, depois de provada a divida e verificada a possibilidade do pagamento. Assim tambem as auctoridades portuguezas farão diligencias para que seja satisfeita qualquer divida que um subdito portuguez tenha deixado de pagar a um subdito chinez. Mas em caso algum o governo portuguez bem como o governo chinez poderão ser considerados responsaveis pelas dividas dos seus respectivos subditos. |

If any Portuguese merchant ship is found smuggling, the goods smuggled, no matter of what nature or value, will be subject to confiscation by the Chinese authorities; who may send the ship away from the port, after settlement of all her accounts and prohibit her to continue to trade. Article XLV
As regards the delivery of Portuguese and Chinese criminals with the exception of the Chinese criminals who take refuge in Macao, and for whose extradition the Governor of Macao will continue to follow the existing practice after the receipt of a due requisition from the Vice-Roy of the two Quangs, it is agreed that, in the Chinese ports open to foreign trade, the Chinese criminals who take refuge at the house or on board the ships of Portuguese subjects, shall be arrested and delivered to the Chinese authorities, on their applying to the Portuguese Consul, and likewise the Portuguese criminals who take refuge in China shall be arrested and delivered to the Portuguese authorities on their applying to the Chinese authorities, and by neither of the parties shall the criminals be harboured nor shall there be delay in delivering them. Article XLVI
It is agreed that either of the High Contracting Parties to this Treaty may demand a revision of the tariff, and of the commercial articles of this Treaty, at the end of ten years, but if no demand be made on either side within six months after the end of the first ten years, then the tariff shall remain in force for ten years more, reckoned from the end of the preceding ten years and so it shall be, at the end of each successive ten years. Article XLVII
All disputes arising between Portuguese subjects, in China, with regard to rights, either of property, or person, shall be submitted to the jurisdiction of Portuguese authorities. Article XLVIII
Whenever Chinese subjects become guilty of any criminal act towards portuguese subjects the Portuguese authorities must report such acts to the Chinese authorities in order that the guilty be tried according to the laws of China. If Portuguese subjects become guilty of any criminal act towards Chinese subjects, the Chinese authorities must report such acts to the Portuguese consul in order that the guilty be tried according to the laws of Portugal. Article XLIX
If any Chinese subject shall have become indebted to a Portuguese subject and withholds payment, or fraudulently absconds from his creditor, the Chinese authorites shall use all their efforts to apprehend him and to compel him to pay, the debt being previously proved and the possibility of its payment ascertained. The Portuguese authorities will likewise use their efforts to enforce the payment of any debt due by any Portuguese subject to a Chinese subject. But in no case will the Portuguese Government or the Chinese Government be considered responsible for the debts of their subjects. |
