Tratado de amizade e commercio entre Portugal e o Império da China/3

DOM LUIZ, por graça de Deus, Rei de Portugal e dos Algarves, d՚aquem e d՚alem mar em Africa, Senhor de Guiné e da conquista, navegação e commercio da Ethiopia, Arabia, Persia e da India, etc. Faço saber aos que a presente carta de confirmação e ratificação virem que, em 1 de dezembro de 1887, se concluiu e assignou entre mim e Sua Magestade Imperial o Imperador da China pelos respectivos plenipotenciarios, munidos dos competentes plenos poderes, um tratado de amisade e commercio para regular as relações entre os dois estados, e uma convenção appensa ao referido tratado, relativa á cooperação na cobrança do rendimento do opio, ambos estes actos ajustados nos termos que constam dos proprios originaes que seguem:

 
 
Tratado de amisade e commercio entre Portugal e a China
 

Sua Magestade Fidelissima El-Rei de Portugal e dos Algarves e Sua Magestade Imperial o Imperador da China, desejando estreitar e consolidar os vinculos de amisade que ha mais de tres seculos subsistem entre Portugal e a China, ajustaram em Lisboa, aos 26 de março de 1887, 2 da 3.ª lua do anno 13.° do reinado do Imperador Kuang Sü, por meio de seus representantes, um protocollo em quatro artigos, e resolveram agora concluir um tratado de amisade e commercio pelo qual se regulem as relações entre os dois estados; para este fim nomearam seus plenipotenciarios, a saber :

 

Sua Magestade Fidelissima El-Rei de Portugal e dos Algarves, a Thomás de Sousa Rosa, seu enviado extraordinario e ministro plenipotenciario em missão especial junto á côrte da China, cavalleiro da ordem de Nossa Senhora da Conceição de Villa Viçosa, gran-cruz do Sol Nascente do Japão e da Corôa de Siam, commendador de Carlos III e de Izabel a Catholica de Hespanha e cavalleiro da Corôa de Ferro de Austria.

 

Sua Magestade Imperial o Imperador da China a Sua Alteza o Principe Ch՚ing, presidente do Tsung-li-Yamen e Sun, ministro do Tsung-li-Yamen e primeiro vice-presidente do ministerio das obras publicas.

Os quaes, depois de haverem trocado os seus respectivos plenos poderes, que acharam em boa e devida fórma, concordaram nos seguintes artigos:

 
Artigo I

Continuará a existir constante paz e amisade entre Sua Magestade Fidelissima El-Rei de Portugal e dos Algarves e Sua Magestade Imperial o Imperador da China, e os seus respectivos subditos gosarão igualmente nos dominios das duas altas partes contractantes de uma plena e inteira protecção para suas pessoas e propriedades.

 
Artigo II

A China confirma, na sua integra, o artigo 2.° do protocollo de Lisboa, que trata da perpetua occupação e governo de Macau por Portugal.

Fica estipulado que commissarios dos dois governos procederão á respectiva delimitação, que será fixada por uma convenção especial, mas emquanto os limites se não fixarem, conservar-se-ha tudo o que lhes diz respeito como actualmente, sem augmento, diminuição ou alteração por nenhuma das partes.

 
Artigo III

Portugal confirma, na sua integra, o artigo 3.° do protocollo de Lisboa sobre o compromisso de nunca alienar Macau sem previo accordo com a China.

 
Treaty of Amity and Commerce between Portugal and China
 

His Most Faithful Majesty the King of Portugal and the Algarves and His Imperial Majesty the Emperor of China, desiring to draw closer and to consolidate the ties of friendship which subsist already for more than three hundred years between Portugal and China, and having agreed in Lisbon on the 26th day of March 1887, 2nd day of 3rd moon of the 13th year of the reign of the Emperor Kuang Sü, through their representatives, on a Protocol of four articles, have now resolved to conclude a Treaty of Amity and Commerce to regulate the relations between the two States; for this end they have appointed as their Plenipotentiaries, that is to say:

His Most Faithful Majesty the King of Portugal and the Algarves, Thomas de Sousa Rosa, His Envoy Extraordinary and Minister Plenipotentiary in special mission to the court of China, Knight of the Order of Nossa Senhora da Conceição de Villa Viçosa, Grand Cross of the Order of the Rising Sun of Japan and of the Crown of Siam, Commander of the Order of Charles III and of Isabella the Catholic of Spain, and Knight of the Iron Crown of Austria.

 

His Imperial Majesty the Emperor of China, His Highness Prince Ch՚ing President of the Tsung-li-Yamen, and Sun Minister of the Tsung-li-Yamen, and Senior Vice-President of the Board of Public Works, who after having communicated to each other their respective full powers and found them to be in good and due form, have agreed upon the following articles:

 
Article I

There shall continue to exist constant peace and amity between His Most Faithful Majesty the King of Portugal and the Algarves and His Imperial Majesty the Emperor of China, whose respective subjects shall equally enjoy, in the dominions of the High Contracting Parties, the most complete and decided protection for their persons and property.

 
Article II

China confirms, in its entirety, the second article of the Protocol of Lisbon, relating to the perpetual occupation and government of Macau by Portugal.

It is stipulated that Commissioners appointed by both Governments shall proceed to the delimitation of the boundaries, which shall be determined by a special convention; but so long as the delimitation of the boundaries is not concluded, everything in respect to them shall continue as at present without addition, diminution, or alteration by either of the parties.

 
Article III

Portugal confirms, in its entirety, the third article of the Protocol of Lisbon relating to the engagement never to alienate Macao without previous agreement with China.

Artigo IV

Portugal concorda em cooperar com a China na cobrança dos direitos sobre o opio exportado de Macau para os portos chinezes, do mesmo modo e durante o mesmo tempo que a Inglaterra prestar igual cooperação á China, na cobrança dos direitos sobre o opio exportado de Hong-Kong para os portos chinezes.

As bases d՚esta cooperação serão estabelecidas por uma convenção appensa a este tratado, e como elle igualmente valida e obrigatoria para ambas as altas partes contratantes.

 
Artigo V

Sua Magestade Fidelissima El-Rei de Portugal e dos Algarves poderá acreditar um embaixador, ministro ou outro qualquer agente diplomatico junto de Sua Magestade Imperial o Imperador da China, e a este agente, bem como aos empregados da missão e suas familias, será permittido fixar a sua residencia em Pekim, visitar esta côrte ou residir em outro ponto onde seja igualmente concedida residencia aos representantes diplomaticos de outras nações, como melhor convier ao governo portuguez.

O governo chinez poderá tambem acreditar, se lhe convier, um embaixador, ministro ou qualquer outro agente diplomatico para residir em Lisboa, ou visitar esta côrte quando o seu governo lh՚o ordenar.

 
Artigo VI

Os agentes diplomaticos de Portugal e da China gosarão, reciprocamente, no logar da sua residencia, de todos os privilegios e immunidades que lhes concede o direito das gentes ; suas pessoas, familias e casas, bem como as suas correspondencias serão inviolaveis.

 
Artigo VII

As correspondencias officiaes enviadas pelas auctoridades portuguezas ás auctoridades chinezas serão escriptas em portuguez e acompanhadas da traducção chineza, servindo de documento a cada nação a versão escripta na sua propria lingua.

 
Artigo VIII

As formulas das correspondencias officiaes entre as auetoridades portuguezas e chinezas serão reguladas pelas suas categorias e posições respectivas, tendo por base a mais completa reciprocidade. Entre os altos funccionarios portuguezes e os altos funccionarios chinezes na capital do Imperio ou em qualquer outro logar, estas correspondencias terão a fórma de officio ou communicação (Chan-hoei); entre os funccionarios portuguezes subalternos e as primeiras auctoridades das provincias usar-se ha para aquelles a fórma de exposição (Xen-chen) e para estas a de declaração (Chah-sing), e os funccionarios subalternos de ambas as nações deverão corresponder-se em termos de perfeita igualdade. Os negociantes, e geralmente todos os individuos não investidos de caracter official, seguirão para com as auctoridades a fórma de representação (Pin cheng).

 
Artigo IX

Sua Magestade Fidelissima El-Rei de Portugal e dos Algarves poderá nomear consules geraes, consules, vice-consules ou agentes consulares nos portos e mais sitios do imperio da China, onde seja permittido a outra nação tel-os. Estes funccionarios terão attribuições e poderes similhantes aos que tiverem os consules de outras nações, e gosarão de todas as isenções, privilegios e immunidades de que gosarem, a todo o tempo, os funccionarios consulares da nação mais favorecida.

Os consules e as auctoridades locaes deverão tratar-se reciprocamente com polidez e corresponder-se em termos de perfeita igualdade.

Os consules e consules interinos terão honras de Tau-tai, e os vice-consules, vice-consules interinos, agentes consulares e interpretes traductores as de prefeito. Os consules devem ser empregados do governo portuguez e não commerciantes. O governo chinez não porá objecção a que Portugal, não julgando necessario nomear um consul para qualquer dos portos, encarregue interinamente o seu consulado n՚esse porto a um consul de outra nação.

Article IV

Portugal agrees to cooperate with China in the collection of duties on opium exported from Macau into Chinese ports, in the same way, and as long as England co-operates with China in the collection of duties on opium exported from Hong-Kong into Chinese ports.

 

The basis of this cooperation will be established by a convention appended to this Treaty, which shall be as valid and binding to both the High Contracting Parties as the present Treaty.

Article V

His Most Faithful Majesty the King of Portugal and the Algarves may appoint an Ambassador, Minister or other Diplomatic Agent to the court of His Imperial Majesty the Emperor of China, and this agent as well as the persons of his suite and their families, will be permitted, at the option of the Portuguese Government, to reside permanently in Peking, to visit that court, or to reside at any other place where such residence is equally accorded to the diplomatic representatives of other nations.

The Chinese Government may also, if it thinks fit, appoint an Ambassador, Minister or other Diplomatic Agent to reside in Lisbon, or to visit that court when his Government should order.

 
Article VI

The diplomatic agents of Portugal and China shall reciprocally enjoy in the place of their residence all the prerogatives and immunities accorded by the law of nations; their persons, families and homes, as well as their correspondence shall be inviolate.

 
Article VII

The official correspondence addressed by Portuguese authorities to the Chinese authorities shall be written in the Portuguese language accompanied by a translation in Chinese, and each nation shall regard as authoritative the document written in its own language.

 
Article VIII

The form of correspondence between the Portuguese and the Chinese authorities will be regulated by their respective rank and position based upon complete reciprocity. Between the high Portuguese and Chinese functionaries at the capital or elsewhere, such correspondence will take the form of despatch (Chan-hoei); between the subordinate functionaries of Portugal and the chief authorities of the Provinces, the former shall make use of the form of exposition (Xen-chen) and the latter that of declaration (Chah-sing); and the subordinate officers of both nations shall correspond together on terms of perfect equality. Merchants and generally all others who are not invested with official character shall adopt in addressing the authorities the form of representation or petition (Pincheng).

 
Article IX

His Most Faithful Majesty the King of Portugal and the Algarves may appoint Consuls General, Consuls, Vice Consuls, or Consular Agents in the ports or other places where it is allowed to other nations to have them. These functionaries will have powers and attributions similar to those of the Consuls of other nations and will enjoy all the exemptions, privileges and immunities which at any time the consular functionaries of the most favoured nation may enjoy.

The Consuls and the local authorities will show to each other reciprocal civilities and correspond with each other on terms of perfect equality.

The Consuls and Acting Consuls will rank with Tau tais: Vice Consuls, Acting Vice Consuls, Consular Agents, and Interpreter-translators, with Prefects. The Consuls must be officials of the Portuguese Government and not merchants. The Chinese Government will make no objection in case the Portuguese Government should deem it unnecessary to appoint an official Consul at any port and choose to entrust a Consul of some other nation, for the time being, with the duties of Portuguese Consul at that port.

 
Artigo X

Todas as immunidades e regalias, e bem assim todas as vantagens em materia de commercio e de navegação, como reducção de direitos de navegação, de importação e exportação, de transito, ou quaesquer outras que tiverem sido ou para o futuro venham a ser concedidas pela China a qualquer estado ou aos seus subditos, serão immediatamente extensivas e applicadas a Portugal e aos seus subditos.

Se, porém, a China fizer a qualquer estado uma concessão sujeita a condições especiaes, Portugal e os seus subditos só poderão participar de tal concessão, accedendo ás condições que lhe são inherentes.

 
Artigo XI

É permittido aos subditos portuguezes habitar ou frequentar os portos da China abertos ao commercio estrangeiro, e ali commerciarem ou empregarem-se livremente.

As suas embarcações poderão navegar livremente entre os portos da China abertos ao commercio estrangeiro e n՚elles importar e exportar d՚elles as suas mercadorias, gosando de todos os direitos e privilegios que tiverem os da nação mais favorecida.

 
Artigo XII

Os subditos portuguezes pagarão sobre todas as mercadorias que importarem ou exportarem os direitos marcados na tarifa de 1858, adoptada para com todas as outras nações, e em nenhum caso lhe serão exigidos direitos mais elevados do que os que pagarem os subditos de qualquer outra nação estrangeira.

 
Artigo XIII

Os subditos portuguezes poderão fretar quaesquer embarcações de que careçam para transporte de carga ou de passageiros, e o preço de taes fretamentos será determinado unicamente pelas partes contratantes sem intervenção do governo chinez. O numero das embarcações não poderá ser limitado, nem tão pouco se permittirá a qualquer fazer monopolio d՚ellas ou dos coolies que se empreguem em carregar mercadorias.

Descobrindo-se que em alguma das embarcações se fez contrabando, os culpados serão punidos conforme a lei.

 
Artigo XIV

Os subditos portuguezes residentes nos portos abertos poderão tomar a seu serviço subditos chinezes e empregal-os em qualquer occupação legal na China, sem nenhuma restricção nem estorvo da parte do governo chinez, mas não poderão contratal-os para o estrangeiro em contravenção das leis da China.

 
Artigo XV

As auctoridades chinezas deverão prestar a mais inteira protecção ás pessoas e propriedades dos subditos portuguezes na China, sempre que corram perigo de soffrer qualquer insulto ou prejuizo. Nos casos de roubo ou incendio, as auctoridades locaes tomarão immediatamente as providencias necessarias para que a propriedade roubada seja restituida, e para que os criminosos sejam presos e punidos conforme a lei.

Igual protecção darão as auctoridades portuguezas aos subditos chinezes que residirem nas possessões portuguezas.

 
Article X

All the immunities and privileges, as well as all the advantages concerning commerce and navigation such as any reduction in the duties of navigation, importation, exportation, transit or any other, which may have been or may be hereafter granted by China to any other State or to its subjects will be immediately extended to Portugal and its subjects.

 

If any concession is granted by the Chinese Government to any foreign Government under special condition, Portugal, on claiming the same concession for herself and for her own subjects will equally assent to the conditions attached to it.

 
Article XI

Portuguese subjects are allowed to reside at, or frequent, the ports of China opened to foreign commerce, and there carry on trade or employ themselves freely.

Their boats may navigate withhout hindrance between the ports open to foreign commerce and they may import and export their merchandise enjoying all the rights and privileges enjoyed by the subjects of the most favoured nation.

 
Article XII

Portuguese subjects shall pay import and export duties on all merchandise according to the rates specified in the tariff of 1858 adopted for all the other nations; and in no instance shall higher duties be exacted from them than those paid by the subjects of any other foreign nation.

 
Article XIII

Portuguese subjects are permitted to hire any description of boats they may require for the conveyance of cargo or passengers, and the price of said hire will be fixed by the contracting parties alone without interference of the Chinese Government. No limit shall be put to the number of boats, neither will it be permitted to any one to establish a monopoly of such boats, or of the services of coolies employed in the carriage of merchandise.

Should contraband articles be on board any such boats, the guilty parties shall immediately be punished according to law.

 
Article XIV

Portuguese subjects residing in the open ports may take into their service Chinese subjects and employ them in any lawful capacity in China without restraint or hindrance from the Chinese Government, but shall not engage them for foreign countries in contravention of the laws of China.

 
Article XV

The Chinese authorities are bound to grant the fullest protection to the persons and to the property of Portuguese subjects in China, whenever they may be exposed to insult or wrong. In case of robbery or incendiarism, the local authorities will immediately take the necessary measures to recover the stolen property to terminate the disorder, to seize the guilty, and punish them according to the law.

Similar protection will be given by Portuguese authorities to Chinese subjects in the possessions of Portugal.

 
Artigo XVI

Quando nos portos abertos ao commercio ou n՚outros quaesquer logares algum súbdito portuguez quizer construir ou abrir casas, armazéns, lojas, igrejas, hospitaes ou cemitérios, o contracto de compra, aforamento ou aluguel d՚essas propriedades será feito pelo preço corrente no local, com equidade, sem extorsão por qualquer das partes, sem contrariar os usos do povo, e precedendo participação do proprietário á auctoridade local.

Fica todavia entendido que só nos portos abertos ao commercio é permittido o estabelecimento de armazéns ou lojas, e não no interior da China.

 
Artigo XVII

Os súbditos portuguezes que quizerem transportar mercadorias entre os portos abertos terão de solicitar do superintendente da alfandega os competentes documentos, conforme se acha determinado nos regulamentos em vigor para as outras nacionalidades.

Os súbditos portuguezes que, sem levar mercadorias, quizerem ir para o interior da China, deverão munir-se dc passaportes, que serão dados pelos seus cônsules e visados pelas auctoridades locaes.

O portador de um passaporte deverá apresental-o nos logares por onde passar quando por elle se lhe pergunte, e estando o seu passaporte regular ninguém poderá pôr-lhe embaraço, especialmente a que alugue embarcação ou carregadores para a conducção das suas bagagens ou mercadorias. Se um viajante for encontrado sem passaporte, ou se commetter alguma offensa contra a lei, será enviado ao consul de Portugal mais proximo para que o castigue, não podendo usar-se contra elle de qualquer medida de oppressão.

São desnecessários passaportes ás pessoas que percorram as vizinhanças de qualquer dos portos abertos ao commercio dentro da distancia de 100 lis (12 léguas) e do praso de cinco dias.

As estipulações d՚este artigo não dizem respeito ás equipagens dos navios, porque para estas os cônsules, de accordo com as auctoridades locaes, farão os convenientes regulamentos.

 
Artigo XVIII

Quando succeda que um navio mercante portuguez seja roubado por piratas ou ladrões nas aguas da China, as auctoridades chinezas deverão empregar a maior diligencia para prender e castigar os ladrões e rehaver a propriedade roubada, que por mediação do consul será restituída a quem pertencer.

 
Artigo XIX

Se algum navio portuguez naufragar na costa da China, ou for obrigado a refugiar-se em qualquer dos portos do mesmo império, as auctoridades chinezas, logo que recebam noticia do facto, tomarão as providencias necessárias para o proteger e soccorrer, acolhendo amigavelmente a equipagem, e prestando-lhe, se preciso for, os meios de se transportar até ao consulado portuguez mais proximo.

 
Artigo XX

Todo o navio mercante portuguez que tiver mais de 150 toneladas, pagará os direitos dc tonelagem a rasão de 4 mazes de prata por cada tonelada. Tendo 150 toneladas, ou menos, pagará a rasão de 1 maz por tonelada. O superintendente da alfandega deverá passar um attestado com declaração dos direitos de tonelagem que tiverem sido pagos.

 
Artigo XXI

Consideram-se pagaveis os direitos de importação no acto de desembarque das mercadorias, e os de exportação no embarque das mesmas.

 
Article XVI

Whenever a Portuguese subject intends to build or open houses, shops or warehouses, churches, hospitals, or cemeteries, at the Treaty ports or at other places, the purchase, rent, or lease of these properties shall be made out according to the current terms of the place with equity, without exaction on either side, without offending against the usage of the people, and after due notice given by the proprietors to the local authority.

It is understood, however, that the shops or warehouses above mentioned shall only be allowed at the ports open to trade but not at any place in the interior.

 
Article XVII

Portuguese subjects conveying merchandise between open ports shall be required to take certificates from the Superintendent of the Custom-house, such as are specified in the regulations in force with reference to other nationalities.

But Portuguese subjects who without carrying merchandise should like to go to the interior of China must have passports issued by their Consuls and countersigned by the local authorities.

The bearer of the passport must produce the same when demanded, and the passport not being irregular he will be allowed to proceed and no opposition shall be offered, especially to his hiring persons or vessels for the carriage of his baggage or merchandise. If he be without a passport, or if he commits any offence aganist the law, he shall be handed over to the nearest Consul of Portugal to be punished, but he must not be subjected to any oppressive measure.

 

No passport need be applied for by persons going on excursions from the ports open to trade to a distance not exceeding 100 li and for a period not exceeding five days.

 

The provision of this article do not apply to crews of ships, for the due restraint of whom regulations will be drawn up by the consul and the local authorities.

 
Article XVIII

In the event of a Portuguese merchant vessel being plundered by pirates or thieves within Chinese waters, the Chinese authorities are to employ their utmost exertions to seize and punish the said robbers and to recover the stolen goods which through the Consul shall be restored to whom they belong.

 
Article XIX

If a Portuguese vessel be shipwrecked on the coast of China, or be compelled to take refuge in any of the ports of the Empire, the Chinese authorities, on receiving notice of the fact, shall provide the necessary protection, affording prompt assistance and kind treatment to the crews and if necessary, furnishing them the means to reach the nearest consulate.

 
Article XX

Portuguese merchant vessels of more than one hundred fifty tons burden will pay tonnage dues at the rate of four mace per ton, if of one hundred and fifty tons and under, they shall be charged at the rate of one mace per ton. The Superintendent of the customs shall grant a certificate declaring that the tonnage dues have been paid.

 
Article XXI

Import duties shall be paid on the landing of goods; and export duties upon the shipment of the same.

 
Artigo XXII

O capitão de um navio portuguez poderá, quando assim lhe convenha, desembarcar uma parte sómente da sua carga em qualquer dos portos abertos, pagando os devidos direitos das fazendas que desembarcar, não se lhe podendo pedir o pagamento dos direitos pelo resto da carga senão quando elle o desembarque em qualquer outro porto.

 
Artigo XXIII

O capitão de um navio portuguez tem faculdade para, dentro de quarenta e oito horas contadas da chegada do seu navio a qualquer dos portos abertos da China, mas não mais tarde, decidir-se a partir sem abrir as escotilhas; e n՚este caso não terá a pagar direitos de tonelagem. É comtudo obrigado a dar parte da sua chegada para o competente registo logo que entrar no porto, sob pena de multa quando o não faça no espaço de dois dias.

O navio está portanto sujeito aos direitos de tonelagem quarenta e oito horas depois da sua chegada ao porto, e nem então, nem á saída, lhe será exigido outro qualquer imposto.

 
Artigo XXIV

Serão livres de pagamento de tonelagem todos os barcos empregados por subditos portuguezes na conducção de passageiros, bagagens, cartas, provisões, ou de qualquer outra carga livre de direitos, entre os portos abertos da China. Porém, se taes barcos conduzirem mercadorias sujeitas a direitos, pagarão tonelagem todos os quatro mezes, a rasão de 1 maz por tonelada.

 
Artigo XXV

Todo o navio mercante portuguez, ao approximar-se de qualquer dos portos abertos, terá a liberdade de tomar um pratico que o faça entrar; e igualmente o poderá tomar para sair, quando haja satisfeito a todos os direitos que dever.

 
Artigo XXVI

Todas as vezes que um navio mercante portuguez chegar a qualquer dos portos abertos da China, o superintendente da alfandega mandar-lhe-ha um ou mais guardas, que poderão ficar na sua embarcação ou passar para bordo do navio, segundo melhor lhes convenha. Estes guardas receberão da alfandega a comida e tudo o mais que precisarem, e não poderão acceitar propina alguma do capitão do navio ou do consignatario, sob pena proporcional á importancia do que acceitarem.

 
Artigo XXVII

Vinte e quatro horas depois da chegada de um navio mercante portuguez a qualquer dos portos abertos, os papeis do mesmo navio, o manifesto da carga e mais documentos deverão ficar entregues ao consul, o qual deverá tambem, dentro de vinte e quatro horas, communicar ao superintendente da alfandega o nome do navio, o registo das suas toneladas e qual a carga que transportou. Se por negligencia, ou qualquer outro motivo, quarenta e oito horas depois da chegada do navio, se não tiver cumprido com o que fica estipulado, o capitão ficará sujeito á multa de 50 taeis por cada dia mais de demora, não excedendo porém o total da pena a 200 taeis.

O capitão do navio é o responsavel pela exactidão do manifesto, no qual deverá declarar a carga minuciosamente e com toda a verdade, sob pena de multa de 500 taeis no caso em que o manifesto seja achado inexacto. Não incorrerá porém na pena quando, no espaço de vinte e quatro horas depois da entrega do manifesto aos empregados da alfandega, queira corrigir algum erro que possa ter descoberto no mesmo manifesto.

 
Artigo XXVIII

O superintendente da alfandega permittirá que o navio descarregue, logo que tenha recebido do consul a nota feita nos devidos termos. Se o capitão do navio começar a descarregar sem permissão será multado em 500 taeis, e os objectos que tiverem sido descarregados serão confiscados.

 
Article XXII

The Captain of a Portuguese ship may, when he deems convenient, land only a part of his cargo at one of the open ports, paying the duties due on the portion landed; the duties on the remainder not being payable until they are landed at some other port.

 
Article XXIII

The master of a Portuguese ship has the option, within forty eight hours of his arrival at any of the open ports of China, but not later, to decide whether he will leave port without opening the hatches, and in such case he will not have to pay tonnage dues. He is bound, however to give, notice of his arrival for the legal registering as soon as he comes into port, under penalty of being fined in case of non-compliance within the term of two days. The ship will be subject to tonnage dues forty eight hours after her arrival in port, but neither then nor at her departure shall any other impost whatsoever be exacted.

 
Article XXIV

All small vessels employed by Portuguese subjects in carrying passengers, baggage, letters, provisions or any other cargo which is free of duty between the open ports of China, shall be free from tonnage dues; but all such vessels carrying merchandise subject to duty shall pay tonnage dues every four months at the rate of one mace per ton.

 
Article XXV

Portuguese merchant vessels approaching any of the open ports will be at liberty to take a pilot to reach the harbour; and likewise to take a pilot to leave it, in case the said ship shall have paid all the duties due by her.

 
Article XXVI

Whenever a Portuguese merchant ship shall arrive at any of the open ports of China, the Superintendent of the Customs will send of one or more Custom-house Officers, who may stay on board of their boat or on board of the ship, as best suits their convenience. These Officers will get their food and all necessaries from the Custom-house, and will not be allowed to accept any fee from the Captain of the ship or from the consignee, being liable to a penalty proportionate to the amount received by them.

 
Article XXVII

Twenty four hours after the arrival of a Portuguese merchant ship at any of the open ports, the papers of the ship, manifest and other documents, shall be handed over to the Consul, whose duty it will be also to report to the Superintendent of the Customs within twenty four hours, the name, the registered tonnage and the cargo brought by the said vessel. If, through negligence or for any other motive, this stipulation be not complied with within forty eight hours after the arrival of the ship the Captain shall be subject to a fine of fifty taels, for each day՚s delay over and above that period, but the total amount of the fines shall not exceed two hundred taels.

The Captain of the ship is responsible for the correctness of the manifest, in which the cargo shall be minutely and truthfully described, subject to a fine of five hundred taels as a penalty in case the manifest should be found incorrect. This fine, however, will not be incurred if within twenty four hours after the delivery of the manifest to the Custom-house Officer, the Captain express the wish to rectify any error which may have been discovered in the said manifest.

 
Article XXVIII

The Superintendent of Customs will permit the discharging of the ship as soon as he shall have received from the Consul the report drawn in due form. If the Captain of the ship should take upon himself to commence discharing without permission he shall be fined five hundred taels and the goods so discharged shall be confiscated.

Todo o negociante portuguez que tiver carga para embarcar ou desembarcar, deverá obter para isso uma permissão especial do superintendente da alfandega, sem o que toda a fazenda embarcada ou desembarcada ficará sujeita a ser confiscada.

Não se poderá baldear fazenda de um navio para outro sem licença especial, sob pena de confiscação de todas as fazendas baldeadas.

 
Artigo XXXI

Quando o navio tiver satisfeito a todos os direitos que dever, o superintendente da alfandega passar-lhe-ha um attestado e o consul restituir-lhe-ha os papeis, para que possa seguir viagem.

 
Artigo XXXII

Quando houver duvidas sobre mercadorias que, segundo a tarifa, pagam direitos ad valorem, e o negociante portuguez não podér concordar com o empregado da alfandega no valor d՚essas mercadorias, cada uma das partes chamará dois ou tres negociantes para as verem, e o preço mais alto que qualquer d՚elles offerecer para as comprar será o justo valor d՚ellas.

 
Artigo XXXIII

Os direitos serão pagos pelo peso de cada mercadoria, depois de deduzida a tara. Se entre o negociante portuguez e o empregado da alfandega houver duvidas no fixar da tara, cada uma das partes escolherá um certo numero de caixas ou de fardos d՚entre cada cem da mercadoria em questão, tomar-se-ha o peso bruto d՚esse volume, fixando depois a tara de cada um d՚elles, e a tara media que resultar será a adoptada para todos.

 

No caso de qualquer outra duvida ou contestação, aqui não designada, o negociante portuguez poderá appellar para o seu consul, o qual communicará a questão ao superintendente da alfandega, e este fará por concluil-a amigavelmente. A appellação, porém, só poderá ser attendida quando seja feita dentro do praso de vinte e quatro horas; e, n՚este caso, até que a duvida seja resolvida, não se poderá fazer nos livros da alfandega assento algum relativo ás mercadorias em questão.

 
Artigo XXXIV

As fazendas avariadas terão uma reducção de direitos proporcional á sua deterioração. No caso de haver duvida, será resolvida como na clausula d՚este tratado relativa ás mercadorias que pagam direitos ad valorem.

 
Artigo XXXV

Todo o negociante portuguez que, depois de importar mercadorias estrangeiras em algum dos portos abertos da China e de satisfazer os competentes direitos, as quizer reexportar para qualquer outro dos mesmos portos, deverá fazer d՚ellas uma relação, que entregar áa osuperintendente da alfandega, o qual, para evitar fraudes, mandará examinar pelos seus empregados se os direitos foram pagos, se as fazendas deram entrada nos livros da alfandega, se conservam as marcas originaes e se os assentos dos livros estão em harmonia com o referido na relação. Achando tudo conforme, declaral-o-ha no certificado do despacho, mencionando tambem o total dos direitos pagos, e de tudo isto dará conhecimento aos empregados das alfandegas dos outros portos.

 
Article XXIX

Portuguese merchants having goods to ship or to land, will have to obtain a special permission from the Superintendent of Customs to that effect without which all goods shipped or landed shall be liable to confiscation.

 
Article XXX

No transhipment of goods is allowed from ship to ship without special permission, under penalty of confiscation of all goods so transhipped.

 
Article XXXI

When a ship shall have paid all her duties the Superintendent of Customs will grant her a certificate and the Consul will return the papers, in order that she may proceed on her voyage.

 
Article XXXII

When any doubt may arise as to the value of goods which by the tariff are liable an ad valorem duty, and the Portuguese merchant desagrees with the Custom-house Officers as regards the value of said goods, both parties will call two or three merchants to examine them, and the highest offer made by any of the said merchants to buy the goods will be considered as their just value.

 
Article XXXIII

Duties will be paid on the net weight of every kind of merchandise. Should there be any difference of opinion between the Portuguese merchant and the Custom-house Officer as to the mode by which the tare is to be fixed, each party will choose a certain number of boxes or bales from among every hundred packages of the goods in question, taking the gross weight of said packages, then the tare of each of the packages separately, and the average tare resulting therefrom will be adopted for the whole parcel.

 

In case of any doubt or dispute not mentioned herein, the Portuguese merchant may appeal to the Consul who will refer the case to the Superintendent of Bustons; this Officer will act in such a manner as to settle the question amicably. The appeal however will only be entertained if made within the term of twenty four hours, and in such a case, no entry is to be made in the Custom house books in relation to the said goods until the question shall havo been settled.

 
Article XXXIV

Damaged goods will pay areduced duty proportionate to their deterioration; any doubt on this point will be solved in the way indicated in the clause of this Treaty with respect to duties payable on merchandise ad valorem.

 
Article XXXV

Any Portuguese merchant, who having imported foreign goods into one of the open ports of China and paid the proper duties thereon, may wish to re-export them to another of the said ports, will have to send to the Superintendent of Customs an account of them, who, to avoid fraud, will direct his Officers to examine whether or not the duties have been paid, whether the same have been entered on the books of the Customs, whether they retain their original marks, and whether the entries agree with the account sent in. Should everything be found correct, the same will be stated in the export permit together with the total amount of duties paid, and all these particulars will be communicated to the Custom-house Officers at other ports.


Chegado o navio ao porto para onde conduz as fazendas, ser-lhe-ha permittido desembarcal-as sem novo pagamento de direitos quando no exame d՚ellas se reconheça serem as mesmas. Quando porém n՚esse exame se descubra fraude, as fazendas poderão ser confiscadas pelo governo chinez.

Se algum negociante portuguez quizer reexportar para paiz estrangeiro fazendas que tenha importado com pagamento dos competentes direitos deverá fazer d՚ellas uma relação, satisfazendo ás mesmas condições exigidas na reexportação para os portos da China, pelo que se lhe dará um certificado de restituição de direitos (drawback), que será acceito em pagamento de direitos de importação ou de exportação por qualquer das alfandegas chinezas.

Os cereaes estrangeiros, que tiverem sido trazidos a algum dos portos da China por um navio portuguez, poderão ser reexportados sem embaraço, quando se não haja desembarcado porção alguma d՚elles.

 
Artigo XXXVI

As auctoridades chinezas adoptarão em todos os portos as medidas que julgarem mais convenientes para evitar a fraude e o contrabando.

 
Artigo XXXVII

O producto das multas e confiscações infligidas, na conformidade d՚este tratado, a subditos portuguezes, pertencerá exclusivamente ao governo chinez.

 
Artigo XXXVIII

Todo o subdito portuguez que transportar para o mercado do interior do paiz mercadorias, de que tenha pago os competentes direitos de importação em qualquer dos portos abertos, ou que comprar no interior productos chinezes para os levar para os portos do Yang-tsi-Kian, ou para os portos estrangeiros, deverá observar o regulamento novamente adoptado para com as outras nações.

Os escrivães e mais empregados da alfandega que não cumprirem o regulamento, ou que exigirem mais direitos do que devem, serão castigados segundo as leis chinezas.

 
Artigo XXXIX

Os consules e as auctoridades locaes deverão consultar-se, quando for preciso, sobre a construcção de torres de pharol e collocação de boias e navios-pharoes.

 
Artigo XL

Os direitos serão pagos aos banqueiros auctorisados pelo governo chinez para os cobrarem em saici ou em moeda estrangeira, conforme o ensaio feito em Cantão aos 15 de julho de 1843.

 
Artigo XLI

Para assegurar a uniformidade dos pesos e medidas e evitar confusões, o superintendente das alfandegas entregará ao consul portuguez de cada um dos portos abertos padrões conforme aos que são dados pela repartição da cobrança publica á alfandega de Cantão.

 
Artigo XLII

Os navios mercantes portuguezes só poderão frequentar os portos da China, que estiverem abertos ao commercio estrangeiro. É-lhes portanto defezo, salvo o caso de força maior previsto no artigo 19.°, entrar n՚outros portos, bem como fazerem commercio clandestino na costa da China; e aquelle que violar esta disposição ficará sujeito a ser confiscado pelo governo chinez com toda a carga que tiver a bordo.

 
Artigo XLIII
 

Todo o navio portuguez que for despachado de um dos portos da China abertos ao commercio, para outro qualquer dos mesmos portos, ou para Macau, tem direito a um certificado da alfandega que o isente de novo pagamento dos direitos de tonelagem durante o periodo de quatro mezes contados da data do despacho.


Upon arrival of the ship at the port to which the goods are carried, permission will be granted to land without any new payment of duties whatsoever, if, upon examination, they are found to be the identical goods; but if, during the examination, any fraud be detected, the goods may be confiscated by the Chinese Government.

Should any Portuguese merchant wish to re-export to a foreign country any goods imported and upon which duties have been already paid, he will have to make his application in the same form as required for the re-exportation of goods to another port in China, in which case a certificate of drawback or of restitution of duties will be granted, which will be accepted by any of the Chinese Custom-house in payment for import or export duties.

Foreign cereals imported by Portuguese ships into the ports of China may be reexported without hindrance, if no portion of it has been discharged.

 
Article XXXVI

The chinese authorities will adopt at the ports the measures which they may deem the most convenient to avoid fraud or smuggling.

 
Article XXXVII

The proceeds of fines and confiscations inflicted on Portuguese subjects, in conformity to this Treaty, shall belong exclusively to the Chinese Government.

 
Article XXXVIII

Portuguese subjects carrying goods to a market in the interior of the country on which the lawful import duties have already been paid at any of open ports, or those who buy native produce in the interior to bring to the ports on the Yang-tsi-Kiang, or to send to foreing ports, shall follow the regulations adopted towards the other nations.

Custom-house Officers who do not comply with the regulations or who may exact more duties than are due shall be punished according to the Chinese laws.

 
Article XXXIX

The Consuls and local authorities shall consult together, when necessary, as to the construction of light-houses and the placing of buoys and light ships.

 
Article XL

Duties shall be paid to the bankers authorised by the Chinese Government to receive them in sycee or in foreign coin according to the official essay made at Canton on the 15th July 1843.

 
Article XLI

In order to secure the regularity of weights and measures and to avoid confusion the Superintendent of Customs will hand over to the Portuguese Consul at each of the open ports standards similar to those given by the Treasury Department for collection of public dues at the Customs at Canton.

 
Article XLII

Portuguese merchant ships may resort only to those ports of China which are declared open to commerce. It is forbidden to them except in the case of force majeure provided for in the article XIX, to enter into other ports, or to carry on a clandestine trat on the coast of China, and the transgressor of this order shall be subject to confiscation of his ship and cargo by the Chinese Government.

 
Article XLIII

All Portuguese vessels despatched from one of the open ports of China to another, or to Macao, are entitled to a certificate of the Custom-house which will exempt them from paying new tonnage dues, during the period of four months reckoned from the date of clearance.

 
 
Artigo XLIV

Se algum navio mercante portuguez for encontrado a fazer contrabando, as mercadorias introduzidas por esta fórma illegal, seja qual for o seu valor ou natureza, ficarão sujeitas a serem confiscadas pelas auctoridades chinezas, que poderão mandar sair do porto o navio depois d՚elle saldar todas as suas contas e prohibil-o de continuar a negociar.

 
Artigo XLV

Quanto á entrega de criminosos portuguezes e chinas, com excepção dos criminosos chinas que se refugiarem em Macau, e para a extradição dos quaes o governador de Macau continuará a seguir a pratica até agora adoptada depois de receber a competente requisição do Vice-Rei dos dois Quangs, fica convencionado que nos portos chinezes abertos ao commercio estrangeiro os criminosos chinezes que se refugiarem nas habitações ou a bordo dos navios de subditos portuguezes, serão presos e entregues ás auctoridades chinezas logo que ellas os requisitem ao consul portuguez; e assim tambem os criminosos portuguezes que se refugiarem na China, serão presos e entregues ás auctoridades portuguezas logo que ellas os requisitem das auctoridades chinezas, não devendo os criminosos ser acolhidos por nenhuma das partes, nem haver delonga na sua entrega.

 
Artigo XLVI

Qualquer das duas altas partes contratantes poderá no fim de dez annos pedir uma revisão da tarifa ou dos artigos commerciaes d՚este tratado, entendendo-se que não sendo feito este pedido dentro de seis mezes contados sobre os primeiros dez annos continuará em vigor a mesma tarifa por mais dez annos contados sobre os precedentes dez, e assim de dez em dez annos.

 
Artigo XLVII

Todas as questões que se suscitarem entre subditos portuguezes na China, com respeito a direitos de propriedade ou de pessoa, serão submettidas á jurisdicção das auctoridades portuguezas.

 
Artigo XLVIII

Quando subditos chinezes se tornarem culpados de qualquer acto criminoso para com subditos portuguezes, as auctoridades portuguezas participal-o-hão ás auctoridades chinezas para que os accusados sejam julgados segundo as leis da China.

Artigo XLIX

Se qualquer subdito chinez tendo contrahido uma divida para com um subdito portuguez se negar a pagar-lh՚a ou fraudulentamente se occultar d՚elle, as auctoridades chinezas empregarão todos os esforços para o prender e obrigal-o-hão a pagar, depois de provada a divida e verificada a possibilidade do pagamento.

Assim tambem as auctoridades portuguezas farão diligencias para que seja satisfeita qualquer divida que um subdito portuguez tenha deixado de pagar a um subdito chinez.

Mas em caso algum o governo portuguez bem como o governo chinez poderão ser considerados responsaveis pelas dividas dos seus respectivos subditos.

 
Article XLIV

If any Portuguese merchant ship is found smuggling, the goods smuggled, no matter of what nature or value, will be subject to confiscation by the Chinese authorities; who may send the ship away from the port, after settlement of all her accounts and prohibit her to continue to trade.

 
Article XLV

As regards the delivery of Portuguese and Chinese criminals with the exception of the Chinese criminals who take refuge in Macao, and for whose extradition the Governor of Macao will continue to follow the existing practice after the receipt of a due requisition from the Vice-Roy of the two Quangs, it is agreed that, in the Chinese ports open to foreign trade, the Chinese criminals who take refuge at the house or on board the ships of Portuguese subjects, shall be arrested and delivered to the Chinese authorities, on their applying to the Portuguese Consul, and likewise the Portuguese criminals who take refuge in China shall be arrested and delivered to the Portuguese authorities on their applying to the Chinese authorities, and by neither of the parties shall the criminals be harboured nor shall there be delay in delivering them.

 
Article XLVI

It is agreed that either of the High Contracting Parties to this Treaty may demand a revision of the tariff, and of the commercial articles of this Treaty, at the end of ten years, but if no demand be made on either side within six months after the end of the first ten years, then the tariff shall remain in force for ten years more, reckoned from the end of the preceding ten years and so it shall be, at the end of each successive ten years.

 
Article XLVII

All disputes arising between Portuguese subjects, in China, with regard to rights, either of property, or person, shall be submitted to the jurisdiction of Portuguese authorities.

 
Article XLVIII

Whenever Chinese subjects become guilty of any criminal act towards portuguese subjects the Portuguese authorities must report such acts to the Chinese authorities in order that the guilty be tried according to the laws of China.

If Portuguese subjects become guilty of any criminal act towards Chinese subjects, the Chinese authorities must report such acts to the Portuguese consul in order that the guilty be tried according to the laws of Portugal.

 
Article XLIX

If any Chinese subject shall have become indebted to a Portuguese subject and withholds payment, or fraudulently absconds from his creditor, the Chinese authorites shall use all their efforts to apprehend him and to compel him to pay, the debt being previously proved and the possibility of its payment ascertained.

The Portuguese authorities will likewise use their efforts to enforce the payment of any debt due by any Portuguese subject to a Chinese subject.

But in no case will the Portuguese Government or the Chinese Government be considered responsible for the debts of their subjects.

 
Artigo L

Quando qualquer subdito portuguez tiver de representar á auctoridade chineza do districto deverá primeiramente levar a sua representação ao consul, que, não a achando inconveniente, a fará entregar, e, no caso contrario, mandará escrevel-a n՚outros termos ou recusará transmittil-a. Igualmente quando um subdito chinez haja de representar ao consul de Portugal, só poderá fazel-o por via da auctoridade chineza, que procederá da mesma fórma.

 
Artigo LI

Todo o subdito portuguez que tiver qualquer queixa ou reclamação a fazer contra um subdito china deverá apresental-a ao consul, que se informará devidamente da questão e empregará todos os esforços para a terminar amigavelmente.

Do mesmo modo quando um subdito china tiver motivo de queixa contra um portuguez, o consul ouvirá attentamente a sua reclamação e fará o possivel para reconciliar as partes.

Se porém a questão for de tal natureza que não possa terminar-se por modo conciliatorio, o consul portuguez e as auctoridades chinezas procederão conjunctamente á investigação do caso e o decidirão com equidade, applicando cada uma d՚essas auctoridades as leis do seu paiz segundo a naturalidade do réu.

 
Artigo LII

Tendo a religião catholica por fim converter os homens ao bem, as pessoas que a ensinarem ou a professarem receberão igualmente efficaz protecção das auctoridades chinezas, que não poderão perseguil-as, nem tolhel-as com prohibições, quando ellas desempenhem pacificamente os seus misteres e não offendam as leis.

 
Artigo LIII

A fim de prevenir para o futuro qualquer discussão, e considerando que a lingua ingleza, entre todas as linguas estrangeiras, é a mais geralmente conhecida na China, este tratado com a convenção a elle appensa, é escripto nas tres linguas, portugueza, chineza e ingleza, e assignado em seis copias, sendo duas em cada lingua. Todas estas versões têem o mesmo sentido e significação, mas se por acaso houver divergencia na interpretação das versões portugueza e chineza servirá o texto inglez para decidir as duvidas que se suscitarem.

 
Artigo LIV

O presente tratado com a convenção a elle appensa, será ratificado por Sua Magestade Fidelissima El-Rei de Portugal e dos Algarves e por Sua Magestade Imperial o Imperador da China. Em seguida á troca das ratificações, que será feita em Tien-tsin, com a maior brevidade possivel, deverá o tratado com a convenção appensa ser impresso e publicado para que os funccionarios e subditos dos dois paizes possam ter pleno conhecimento das suas estipulações e as observem.

 

Em fé do que os plenipotenciarios assignaram e sellaram o presente tratado.

 

Feito em Pekim, no 1.º dia do mez de dezembro do anno de Nosso Senhor Jesus Christo de 1887, que corresponde ao dia 17.° da 10.a lua do 13.° anno de Kuang-Sü.

Article L

Whenever any Portuguese subject shall have to petition the Chinese authority of a district, he is to submit his statement beforehand to the Consul, who will cause the same to be forwarded should he see no impropriety in so doing, otherwise he will have it written out in other terms or decline to forward it. Likewise when a Chinese subject shall have occasion to petition the Portuguese Consul, he will only be allowed to do so through the Chinese authority who shall proceed in the same manner.

 
Article LI

Portuguese subjects who may have any complaint or claim against any Chinese subject, shall lay the same before the Consul, who will take due cognizance of the case and will use all his efforts to settle it amicably. Likewise, when a Chinese subject shall have occasion to complain of a Portuguese subject, the Consul will listen to his complaint and will do what he possibly can to re-establish harmony between the two parties.

If however the dispute be of such a nature that it cannot be settled in that conciliatory way, the Portuguese Consul and Chinese authorities, will hold a joint investigation of the case and decide it with equity applying each the laws of his own country according to the nationality of the defendant.

 
Article LII

The catholic religion has for its essential object the leading of men to virtue. Persons teaching it and professing it shall alike be entitled to efficacious protection from Chinese authorities; nor shall such persons, pursuing peaceably their calling and not offending against the laws, be persecuted or interfered with.

 
Article LIII

In order to prevent for the future any discussion and considering that the English language, among all foreign languages, is the most generally known in China, this Treaty, with the special convention appended to it, is written in Portuguese, Chinese and English, and signed in six copies, two in each language. All these versions have the same sense and meaning, but if there should happen to be any divergence in the interpretation of the Portuguese and Chinese versions the English text will be made use of to resolve the doubts that may have arisen.

 
Article LIV

The present Treaty with the convention appended to it shall be ratified by His Most Faithful Majesty the King of Portugal and the Algarves and His Imperial Majesty the Emperor of China.

The exchange of the ratifications shall be made, within the shortest possible time, at Tien-tsin after which the Treaty, with the convention appended, shall be printed and published in order that the functionaries and subjects of the two countries may have full knowledge of their stipulations and may fulfil them.

In faith whereof the respective plenipotentiaries have signed the present Treaty and have affixed their seals thereto.

Done in Peking this first day of the month of December in the year of Our Lord Jesus Christ one thousand eight hundred and eighty seven, corresponding with the Chinese date the 17th day of 10th moon of 13th year of Kwang-Sü.
